Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as the "Regulation"), the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the protection of personal data.
1. General provisions
This Privacy Policy sets out:
- What personal data we collect and process about you and to what extent this relates to our relationship with you as a customer;
- Where the data comes from;
- How we treat that data;
- How we store data;
- To whom we communicate/disclose that data;
- How we deal with your data protection rights;
- How we comply with data protection rules.
All personal data are collected and processed in accordance with the requirements for processing personal data set out in the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts related to the protection of personal data, as of 25 October 2020 - the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data).
2. Definitions
Data Controller - UAB Motomafija (hereinafter - https://motomafia.lt/en/), company code 303463387, VAT payer code LT100009175616, e-mail address - info@motomafia.lt.
Data Processor - service providers who provide services (perform work) and process your data on behalf of Motomafija UAB as the data controller. Processors have the right to process personal data only on our instructions and only to the extent necessary for the proper performance of their contractual obligations.
Data subject means a customer - a natural person who has purchased or ordered goods from UAB Motomafija.
Personal data means any information relating to a natural person, namely a data subject, who is identified or can be identified, directly or indirectly, by reference to data such as a personal identification number or to one or more factors specific to that person, be they physical, physiological, psychological, economic, cultural or social.
Processing of personal data shall mean any operation or set of operations which is performed upon personal data, such as collection, recording, accumulation, storage, classification, grouping, aggregation, alteration (addition or rectification), communication, disclosure, use, logical and/or arithmetical operations, retrieval, dissemination, destruction, or any other operation or set of operations.
Cookies are short pieces of text information that websites transmit to the computers or other devices of users who browse them. Depending on your browser, this information is stored either in small individual files or in a common file of cookies stored by different websites. Cookies are used by most advanced websites in Lithuania and abroad. Cookies can only be transferred if there is an option to do so in the settings of your device.
3. What personal data we collect
We process your personal data in order to administer your purchase process www.https://motomafia.lt/en/ in the online shop. To register www.https://motomafia.lt/en/ page and create an account, you must be sure to provide the following information:
- Name(s), surname(s);
- Contact details (email address).
- Password
To buy www.https://motomafia.lt/en/ in the online shop, you must provide the following information:
- Name(s), surname(s);
- Contact details (phone number, email address);
- Delivery address;
- Payment details (including but not limited to bank account number);
- IP address;
- Gender;
- Purchase history;
- Date of birth.

If you do not provide the necessary personal data, you will not be able to proceed with the purchase process and we will not be able to sell you goods or services.

4. What we use your personal data for
Your data may be used for the following purposes:
- To provide the products and services you want to buy. We use the data to process your orders for goods, to resolve issues related to the provision or delivery of goods, and to comply with other contractual or legal obligations of the Republic of Lithuania and the EU;
- To contact you if there are any changes to the delivery time or other information relating to your order. These communications are not for marketing purposes and cannot be opted out of.
We will only process your personal data if we have a legal basis for doing so. The legal basis will depend on the reasons why we collected your personal data and what we use it for.
Consent is only available to persons aged 16 or over. For younger children, the consent of the child's parents or legal guardians is required.
In determining the appropriate retention period, we take into account the amount, nature and sensitivity of the personal data, the purposes for which we process your personal data and whether we can achieve these purposes by other means. In addition, we must take into account the periods for which we may need to keep personal data in order to comply with our legal obligations (e.g. accounting records, leasing contracts, etc.).
When we no longer need your personal data, we will securely delete or erase it. We will also take into account whether and how we can minimise our use of personal data over time and whether we can anonymise your personal data so that it is no longer linked to you or your identity, in which case we may use that information without further notice.
Other purposes for collecting personal data:
- In many cases, we will need to process your personal data in order to enter into a contract for the sale of goods with you.
- We use the information you provide to us to ensure a smooth purchasing process and order fulfilment;
- The information you provide helps us to communicate with you smoothly and to answer your questions;
- The Customer's data may be used for marketing purposes at the time of ordering.
The customer may give his/her consent/non-consent to the use of his/her personal data for direct marketing purposes. He can do so by ticking (I agree to the use of my personal data for direct marketing purposes) or by not ticking (I do not agree). The Data Controller sends the newsletter to the email address indicated by the customer after receiving the Customer's consent. The Data Controller also allows the Customer to unsubscribe from the newsletter (by selecting "unsubscribe" at the end of the newsletter);
- Based on your data, we contact you if you have forgotten your purchases or if we find problems with your completed orders;
- We use the data provided for administrative or legal purposes: to settle disputes or claims.
5. How and for how long we keep your data
We will not keep your data for longer than is necessary to achieve the purpose for which it is processed. When we no longer need your personal data, we will securely delete or erase it. We will also take into account whether and how we can minimise our use of personal data over time and whether we can anonymise your personal data so that it is no longer linked to you or your identity, in which case we may use that information without further notice.
We have implemented appropriate organisational and technical security measures to protect personal data against accidental or unlawful destruction, alteration, disclosure or any other unauthorised processing. The security activities carried out by Motomafija UAB also include the protection of personnel, information, IT infrastructure, internal and public networks, as well as office buildings and technical installations.
For the purpose of direct marketing, personal data may be processed for a period of 10 years from the moment of consent to the processing of personal data. Where personal data are processed in the context of promotional campaigns (direct marketing games, lotteries, competitions), personal data shall be processed for one year after the results of the promotional campaign, the announcement of winners. After the expiry of the processing period, the personal data shall be destroyed by an authorised employee of the company.
We aim not to store outdated or redundant information and to ensure that personal data and other information about our customers is kept up-to-date and correct.
6. Who we provide your data to
Data processors who provide services to us (e.g. bookkeeping) and process your data on behalf of Motomafija UAB as the data controller. Processors are only entitled to process personal data on our instructions and only to the extent necessary for the proper performance of the obligations set out in the order.
When we use subcontractors, we take all necessary measures to ensure that our processors also have appropriate organisational and technical security measures in place and that they maintain the confidentiality of personal data.
Responding to requests from a court or public authority, only to the extent necessary for the proper enforcement of applicable law or a court order/certificate.
7. Your rights
You have the right to:
- to know (be informed) about the processing of your data (right to know);
- to know your data and how they are processed (right of access);
- require rectification or, taking into account the purposes of the processing of the personal data, completion of incomplete personal data (right of rectification);
- to have your data erased or to stop the processing of your data (except for storage) (right to erasure and right to be forgotten);
- require the Data Controller to restrict the processing of personal data on one of the legitimate grounds (right to restrict);
- the right to object to the processing of his or her personal data or to withdraw his or her consent to the processing of personal data for one or more specific purposes at any time, without prejudice to the lawfulness of the processing based on consent prior to the withdrawal of consent.
In order to make a request concerning the personal data collected and used about him/her, the Client shall only have the right to receive such data by submitting a request to the following e-mail address: info@motomafia.lt. Motomafia.lt, upon receipt of a data subject's enquiry regarding the processing of his/her personal data, shall reply whether the personal data concerning him/her are being processed and shall provide the data subject with the requested data not later than 30 calendar days from the date of the data subject's enquiry, taking into account the specific circumstances of the processing of personal data. This period may be extended by a further two months if necessary, depending on the complexity and number of requests.
Such data shall be provided in writing at the request of the data subject.
In order to protect against unauthorised disclosure of data, https://motomafia.lt/en/ is obliged to verify the identity of the data subject upon receipt of a data subject's request to provide the data or to exercise other rights.
8. Use of cookies

Motomafika UAB uses tracking software to monitor the website visit habits and usage of its customers. Based on the tracking results, we can create a more user-friendly website design and layout. This software does not collect any personal customer information.
We generally use the information collected through cookies for the following purposes:
- For the use of functional cookies and the provision of services. Cookies are essential for the functioning of our website and electronic services and ensure a smooth user experience. For example, if the user so requests, they do not need to enter their name, password or any other data each time they log in.
- For service development. By monitoring the use of cookies, we can improve the performance of our website and electronic services. We receive information such as which parts of our website are most popular, from which websites they connect to our website and how much time users spend on our website.
- For use in analysis. We use cookies to compile statistical data on the number of visitors to our websites and the use of our online services, and to evaluate the effectiveness of advertising. We may collect information, for example, from emails and newsletters sent for marketing purposes, in order to find out whether the emails have been opened and whether they have prompted users to take any action, for example, whether the user clicked on a link to our website in the email.

9. Amendment of the Provisions
The Data Controller shall have the right to amend the Terms and Conditions in whole or in part on its own by notifying www.https://motomafia.lt/en/ in the online shop. Amendments or changes to the Terms and Conditions shall become effective upon their publication in the online shop www.https://motomafia.lt/en/ of the moment.
If the Buyer continues to use the services provided by the e-shop after the changes to the Terms and Conditions, the Buyer shall be deemed to accept the new version of the Terms and Conditions.
The Buyer may reject the new version of the Regulations by submitting a written objection.
10. Final provisions
The cooperation between the controller and the buyer, as the data subject, is based on the principles of fairness and legality.
All notifications relating to the processing of personal data shall be made to the Data Controller by email to info@motomafia.lt. The Data Controller shall, upon receipt of the Buyer's request, reply to the Buyer's e-mail address.
